By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

By placing your order you agree to be bound by these "Terms" as we will call them from now on. Therefore, please make sure you have read and understood them before ordering. 

These terms and conditions apply when you place an order with us via the website “www.HouseOfZoraj.com” (from now on referred to as the "Online Store or site").

By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

HoZ  wants to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the hm.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of a user who violates any of the provisions of these terms and conditions or whose acts, as per HoZ’s understanding, are detrimental to the interests of HoZ in any manner. 

HoZ sells its products directly through Online Store and not through any other third party(s) or agent(s). You may please contact our Customer Service if you wish to know further details on the authorized Online Stores.  

HoZ does not control, endorse or accept responsibility for any products proposed to be sold or offered to be sold or purchased on the website or any linked sites other than the authorized Online Stores. HoZ makes no representations or warranties whatsoever about and shall not be liable for any transaction through such third partie(s) or agent(s) including representations relating to merchantability, fitness of a product or service for a particular purpose, warranty as to specific products and non-infringement of third party intellectual property rights. Any transactions that you may have with such third partie(s) or agent(s) are at your own risk. HoZ also does not accept any responsibility for the usage of the products, fraudulent or illegal activities, non- payment, delivery of the products purchased by you from such third partie(s) or agent(s) .

HoZ specifically disclaims any liability with regard to any infringing, illegal,  fake, spurious, duplicate, counterfeit or defective, refurbished products purchased by you from such third party.

 

SECTION 1 – ONLINE STORE TERMS

A breach or violation of any of the Terms will result in an immediate termination of your Services.

Disclaimer: None of the accessories displayed in the pictures are shipped with the product and are purely for decorative purposes only. We do not accept exchanges or returns on these items.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3- PRICES AND DELIVERY CHARGES

The prices displayed in the Online Store include the applicable statutory tax  /Goods and Services Tax (GST), and also includes delivery charges.

We may from time to time offer promotions, discount codes, gifts and other offers. Such offers cannot be combined with other discounts. You need to fill in the discount code for the offer before completing the purchase in order to use the offer.

 

SECTION 4- DELIVEREY

So, when will my order arrive, you wonder?

Even though we do our very best to deliver within the communicated time frame, delivery may sometimes take longer due to unexpected events.

Sometimes life gets in the way, and you forget to respond to the carrier. That's fine, we've all been there. However, if your order cannot be delivered after 3 attempts, the order shall be returned back to origin. A nominal cost of return will be charged to you. Subsequently, your order amount will be automatically refunded to you in the original form of payment. 

HoZ reserves the right of not delivering the order to you in case of force majeure events, political unrest or other unforeseen circumstances.  

In case a delivery is temporarily not possible for your location or pin code on account of factors mentioned hereinabove, then your order will not be placed on our Online Store, and you will be notified of the same.

Whereas in cases where your order is successfully placed on the Online Store and subsequently your location or pin code becomes temporarily unserviceable, and incase the order has already been picked up by the delivery partner, then the delivery partner will attempt delivery with extended timelines if the specific dates for delivery are clearly available. However, if there are no specific timelines available, then the parcel will be returned to the origin and the refund process will be initiated.

In case your order is placed and if your location or pin code is not serviceable before the order has been packed, then HoZ will cancel your order and notify you through email and a refund shall be initiated to you upon such cancellation. 

SECTION 5- RETURNS

You have the right to return any or all items in your order, by notifying us and returning the items within 7 days after placing your order.

You can return your order by simply placing a return request on the Online Store.

After that, please place the item you wish to return in the parcel the item was received in and hand it over to the delivery person assigned to carry out the pick-up.

Please include the correct and complete item in the parcel, otherwise we will not be able to process your return.

 If you choose to make a return, we will refund you the order value except the cost of delivery. Furthermore, should you choose to keep certain items and only return parts of your order, the delivery cost will not be refunded.  

The refund will be made to the same payment method you used to place the order, within 30 days of us receiving the items back.

We will give you a full refund for any returned item provided that it is returned in the same condition as it was in upon your receipt. If an item in any way has been damaged, soiled, washed, altered or worn (other than to try the item on) and the value of the item has been reduced, in such cases we offer no refund. 

 

SECTION 6– ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

SECTION 9 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In no case shall HOUSE OF ZORAJ, our directors, sole proprietor, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

All reasonable efforts are made to ensure that information in our Online Store is accurate, complete, and current at the time of uploading on the Online Store. We do our best to accurately display and describe the attributes of our products in the Online Store regarding measurements, composition and colours. 

However, the colour you may see depends on your device. Our measurements are only approximate values to better estimate the model or fit of that specific item. It is not a guarantee of the actual measurements of the item you receive since the final measurements may vary depending on the material used in its production. If you are not satisfied with the item you ordered, you may return the item, subject to the conditions.

In case an event beyond our control occurs, and which we are not able to reasonably overcome or anticipate, we will no longer have an obligation to fulfil our contract with you. Such an event might include government action or commission, new legislation, labour law conflict, war or danger of war, major disturbance of public order, sabotage, extreme weather conditions, fire, explosion, pandemic, epidemic, virus, and natural disasters. If any of these events occur, we are not obliged to compensate you for any damages.

HoZ  is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, pandemic or epidemic disease, nuclear accident and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order on the Online Store shall be limited to the total price of your order.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend and hold harmless HOUSE OF ZORAJ and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

All trademarks, copyright and other intellectual property rights in all content including brand names and logos or software contained on the Online Store, including emails or any other form of communication with you is protected by copyright right laws and shall remain at all times vested in House of Zoraj.

You are permitted to use the content posted on our website only to the extent authorized by HoZ.

HoZ may at its own discretion provide the functionality to allow you to provide product ratings and reviews (“User Content”) in relation to its products. 

In such a case, you are solely responsible for such User Content, and the customer warrants that any User Content posted by you is accurate and that you are the sole author. 

You hereby assigns to us all intellectual property rights in any User Content posted on the Online Store. HoZ reserves the right to remove User Content which in its sole opinion is deemed to be incorrect, offensive, illegal or otherwise unacceptable.
